Record restriction is the process of removing arrests, criminal charges, and in some limited exceptions, criminal convictions from one’s personal criminal history report.
Individuals are eligible for record restriction when charges are dismissed or are not prosecuted, or the individual was convicted of certain misdemeanor offenses. Limited exceptions include cases that were placed on a court’s Dead Docket or cases that are eligible for Retroactive First Offender sentencing.
